Using these three cases:
Tinker v. Des Moines School District, 393 U.S. 503 (1969)
Bethel School District No. 43 v. Fraser, 478 U.S. 675 (1986)
Hazelwood School District v. Kuhlmeier, 108 S.Ct. 562 (1988).
Reading commentary about the cases in the legal and popular literature is recommended. After reading the cases and related materials, write a paper in which you:
°Clearly state the First Amendment issue that runs through the three cases.
°Clearly trace the court’s rulings on the First Amendment issue, starting with
the earliest case and ending with the most recent (precedent-setting) case. After reading this section, I should know what the major points of contention were in the three cases and what the current legal standard is.
°In a third section, explain whether or not you agree with where the courts
have ended up on the particular First Amendment issue.
Your paper should be NO LONGER than five pages, double-spaced.
Lexis/Nexis is the place to get the citations for the paper. The cases should be the only citations. And use the correct page numbers from the case themselves.
